HOA President attacked me in parking lot

I drove home last night around 10 and noticed my street was packed with cars. I forgot it was Cinco de Mayo and there are two bars across the street from my condos. Weekends are pretty crazy anyway, but I was being especially careful to watch for 'drunks' because my daughter was in her carseat in back.

I pulled into the parking lot and 7 to 8 people were standing in the middle of the condo entrance..including a young boy and his dog. I stopped and waited for them to move...I thought they were just out walking the dog. The lady in front of my car would not move. I just sat there...waiting. Then she started yelling at me and I thought "Uh oh...she's mad because she thinks maybe I tried to 'run over' her son or something." Next thing I know, my car is surrounded by several adults YELLING at me: "Who are you?", "Where do you live?", "What's your name?" I was trapped..I couldn't go forward or back without hitting someone. I started to panic and my daughter (who is special needs) started to get really upset.

Then one lady came over to the passenger side window and stuck her face right up to my daughter and motioned for me to roll down the window. HECK NO!!! I am a single woman with a small child...late at night..and my car is surrounded by an angry mob. Scared the &%#^ out of me.

The lady in front moved a little and I was able to move forward. As I started to go, the lady at my daughter's window started pounding on the window and kicked my car.

I pull up in my space and they all turn and are ALL YELLING at me and the window lady is walking towards me...YELLING that I can't park there!! I pointed my finger and shouted "Stop. Get away from me." But she kept coming at me. Again, I shouted "Stop talking to me. Go away." In the meantime, my daughter ran upstairs to our house crying. She was terrified.

I immediately called 911...I was shaking so bad...I could hardly talk.

CAN YOU BELIEVE....it turns out the window lady is the president of our HOA!!!??? She and her gang of goonies were 'guarding' the parking lot to make sure none of the Cinco de Mayo bar patrons parked on the property. WHAT??!!!

I filed a police report and said I wanted to press charges against the HOA president (aka, the window lady), but don't know if anything will happen.

Am I the only one that thinks that is TOTALLY crazy? Does the HOA or any of it's members have the right to attack and harrass people. I was honestly scared. I truly thought it was a group of drunk friends looking to 'beat me down' because she thought I was going to run over her son or something.

Do I have a case to sue the HOA President personally? Or the HOA as a whole? Or even the management company for being aware of the ongoing problems and complaints against 'window lady' and not reigning her in. Does that make the HOA itself and the management company legally or criminally liable for her actions and behavior?

Anyone with any advice or comments...please let me know. I'm not sure what is the next step to take. However, I DO know that attacking me and my daughter without cause or warning is NOT RIGHT!!!

The HOA doesn't have the right to attack and harass people, but most of what happened doesn't amount to attacking and harrassing. You might have a case to sue the person who pounded on your car, if they caused any damage. Frankly the rest of it sounds like an unfortunate lack of communication. MAYBE false imprisonment, but I'm not sure you had no way of escaping the situation.
 
Ya...I guess I could have run over one of them to get away. lol.

The same Window Lady chewed me out again today. I was taking pictures of the property, as advised by the responding officer Tuesday night, and Window Lady ran out and started yelling again and said she was going to call the police on me.

She really is a nuisance :(

If your vehicle was damaged send a copy of the repair estimate and a copy of your police report to the Homeowner's Association.

The Association should have liability insurance and D & O insurance. The HOA president would be "financially" protected with the Director & Officer's Insurance. Thus send your complaint to the Association.

If they ignore it, then request the name of their insurer. You are entitled to this info since you are part of the Association. Then send your repair estimate, police report, and a description of the situation directly to the insurer.

Good luck... HOA directors can be PIAs when they have nothing better to do in life!! :)

She didn't damage my car...I am more worried about my daughter. That was 6 days ago. When I woke her up for school Wednesday morning, she said her tummy still hurt from last night. Then, after school she was playing at her dad's and called and asked if it was ok to spend the night there. She said she is scared to come home. When I asked why, she said she was scared of 'Mildred'. She hasn't been home since....

There may not be any 'laws' that cover what this psycho lady did to us, but just common sense tell me...people should not act that way.

I guess I am more angry that she terrified my daughter. However, it has progressed to the point where I have to look out my 'peephole' before I go outside because I know she is 'out there'. lol!! I was urged by the same officer to file a restraining order.

I also wrote a letter to the HOA and the property management company...no reply from either. Big surprise...they never return calls.

I thought , I was the only one that went through that these people act like they own the place when they are homeowners just like the rest of us is there no justice!...
