HOA rule enforcement

Recently our homeowners association (HOA) has been issuing warnings for a variety of homeowner-related things (uncut lawn, garage can in view, etc.). The HOA is all volunteer and we pay dues each year for common street maintenance, etc. There has been an issue lately for the warnings for gargbage cans that can be visible from the street - apparently it against the rules. However there has been no enforcement of this for ~4 years (in fact many people complain they didn't even know of the rule). But since there are more committee members there is more notice and therefore an flood of warnings.

Is this legal (i.e., the inconsistent enforcement of the HOA rules)?
Can they really start fining us (I think it is listed in the rules after the 3rd notice)?
