Hi,
I have a problem wiht my HOA. The backyard of my house is open to the commuinity. The HOA decided to put a fence all around the main road or our commuinity but they decide for whaterver reason to stop the fence behind my house so now people just go through my backyard to cut throught . I have contacted the HOA Board people and advice about this and aks for a solution because sometimes I'm seating in my backyard and people are coming throught there. I would like to know what my options are if the HOA don't do anything ?
Thank you.

This one of many reasons why one should never buy a home that is controlled by a HOA.
What you are experiencing is the same thing one might experience if they rented an apartment.

You can try to negotiate a settlement with the HOA to continue the fencing.
You might sweeten the deal by agreeing to split the cost with them.

Barring a mutually satisfactory agreement, you can hire a lawyer and sue them.
That is tough, because most HOA's have ironclad by-laws.
It is very hard to sue them.
They are almost immune to suits.

I'd speak with them and ask them to work with you and split the cost.

If that isn't your cup of tea, speak with a local lawyer and see what you can do in NC.
Either way, this looks like it will cost you some money!

Thank you very much for your advice. I will try, but the funny thing is that something like this happened last year to other neighbors and because their backyard is close to a gas station they put the fence mine is not but now all the people that were going through their backyard are cutting through mine, because it is open in my side.
