I have a few questions. Let me give you a brief recap. My HOA has never really run properly, and I have had problems with them and the management company they hire to "assist" them from the get go, they even go so far as to tell me I'm stupid and can't read because I had a question about contradicting items in the rules. Anyway, in March I received a "friendly notice" for having toys on my deck in the winter. Despite the rules saying that seasonal toys may be kept in an inconspicous place if not in the garage. Anyway, two weeks later, my friend picked up these toys and sold them in a garage sale. Six weeks after my friend picked up these toys, I receive a "violation hearing notice". When I asked them about it, because I did have new toys but by this time it was well into spring, so I have every right to have my kids toys out there. They told me, oh well, just come to the hearing, and if you don't come we're going to fine you. So my friend who picked up the toys and I go to the meeting with pictures of the toys in front of her house, dated ads from websites with links etc,. At the meeting they told my friend that she was a liar, and never looked at the physical evidence I brought, but then told me that there was no violation. A week later, i receive a violation notice. I contacted them about this and they said that they changed their minds after I left. But were being nice by not giving me a fine. The problem is now they can fine me at their descretion for anything, so I don't want this hanging over my head. What are my options?

Also, any time I try to contact them, and I tell them I want answers from the Board of Directors, since that's who I write my check to, and when I try to get answers from the management company they hired, I don't get satisfactory answers, they say, oh well, you have to talk to them. Isn't it, if you write a check to a company, you have to right to get answers directly from that company if you can not get good answers from their "customer service" type thing??

Isn't it, if you write a check to a company, you have to right to get answers directly from that company if you can not get good answers from their "customer service" type thing?? Demand responses from those who are managing or have been hired to manage the HOA.

But I never violated the bylaws in the first place, so now the way the "master deed" is set up, any more "infractions" I can be fined for, but my so called first infraction never existed.

Also, my second question was if you are dealing with any company that farms out their customer service and you can not get satisfactory answers from the customer service company, don't you have a right to get answers directly from the company it's self since that's who you pay? Weather the company is a HOA that uses a management company or Dell that farms their customer service out to India, if you don't get good answers from the customer service, aren't you allowed to get answers directly from the people you write your check to?? It seems to me that there would be some sort of comsumer advocate law that says that

Per your own words, you have violated the bylaws.

If you are not satisfied with the level of customer service you are receiving from the HOA management company, you can always write as many complaints as you deem necessary until the issue is addressed. Good Luck!
