If a patient that is admitted in maternity ward and states to hospital staff that parent does not agree to a drug screen on the infant whom has the legal rights here? Can your rights as a parent be over ruled by medical staff and their policies? Can your refusal to agree to such a test on your newborn infant result in the Hospitals denial of immediate health care to you and your newborn? IS such actions without consent legal? Can that be considered coercion ? Can this policy be considered 'profiling' of pregnant women?

in most states the medical staff has the ability to drug screen if they suspect drug exposure. This is to protect an infant as sending the child home with a drug addicted mother will lead to sure disaster.

Infants born drug exposed have many health problems and social services often steps in and removes the child.

Out here in AZ, screening can be done if the staff/parent/family member suspects drug exposure, I am not sure what the laws in TX are. Mom really has no right to refuse a drug screen on an infant, especially if mom tests positive. When you give birth to a drug exposed infant, you lose alot of your rights. The medical staff usually has the right to test under certain circumstances.

The parent's refusal to agree to such a test on the newborn in effect constitutes Hospitals denial of immediate health care.
