My jurisdiction is: Arizona
Hello. I was notified by a fellow neighbor last night that the large tree in the front yard of the house next door was on my roof. We ran out to see that the main trunk of the tree was balanced on the corner of the neighbors house, and the mid and upper limbs were on my house. The reason the tree fell is because there was some work being done on the plumbing and the contractor dug a 6 ft deep, 10 ft long and 3 ft wide hole next to the tree, cutting through the whole root system on that side of the tree. The tree, having no support on the right side, fell to the left. This work was done over 2 weeks ago, they have not been out since. The house is a pending sale as I understand it. I called the company who is selling the house, and they said they were trying to get someone to come out this week, they would see what they could do. However, I am pretty freaked out right now because this is going to land in my bedroom when the next monsoon storm comes up.
So to get to my question, if I have the tree removed at my expense since I was not overly reassured that the real estate company is taking this seriously, is there a way to recover the costs of this along with the costs of any repair work that might need done? Do you have any thoughts on how best to handle this? I have about 2 days of monsoon downtime before the next storms hit and I am really worried. Thank you so much for any help you can provide.
