house is sinking!!!!

I had an addition and garage built on my existing house 2 years ago. About 6 months after it was built I notified the contractor about damages that were starting to surface, i.e. walls cracking, leaks in the roof, the cement for the garage floor split all the way down the middle. The contractor came out (reluctantly) and said the reason for the damages were from my existing house not having enough insulation. Well Ive contacted him a few more times in an attempt to fix the damages but he refuses. Now the damages are significantly worse, the addition is sinking into the ground, all the sheet rock screws are now exposed from the walls warping, my 2 year old sons room is starting to cave in, there is too much water damage and cracks (some over 2 feet long) to list, and the damage goes on and on from there.
The situation gets a little worse. When the addition and garage was built I asked the contractor to over price the estimate. At the time my wife was pregnant and our existing house was a one bedroom, so we needed the house expanded, but we could not afford the cost of the mortgage because of an auto loan we had that was extremely overpriced due to losing three transmissions in the vehicle (lemon law would not cover). Anyway the contractor agreed but we got screwed along the way. He only gave us back half the money that was agreed upon, we paid his contractors insurance, paid for debris removal (which was never removed), and we also paid for the garage doors, electrical, heating, carpets and paint. Well my house is now falling down, and the contractor refuses to fix anything without full compensation. My questions are these: Have I done anything illegal? How do I get the contractor to fix the house? should I take this to court? Will home owners insurance cover this? I am in desperate need of help. Can somebody please help???????
