I live in a housing development with an annual maintenance assessment. The paragraph describing this assessment includes the following sentence:

"The annual assessment shall not be increased except by vote of sixty percent or more of the lot owners."

My question -- Does the above statement in any way preclude a vote to DECREASE the assessment?

The statement you inquired about requires a vote to raise your assessment.
The doesn't doesn't prohibit owners from voting to decrease assessments!
In my legal opinion, you would NOT have to get 60% to lower assessments, either.
I predict you'll get 75% (at least) of the owners voting to lower taxes during our current depression!
