How can I collect on a judgement?

In November of 2009, I received a small claims judgement in my favor in the amount of $7,000 (+$125 in court expenses). The judgement was against a small business located in my city in California for money they owe me.

Until now, I have not thought about collecting the money because I was dealing with the death of my mother, but I would like to attempt to collect this money now, if possible.

What can/should I do in an attempt to collect on this judgement? An acquaintance, who is also a lawyer, told me to have a police officer accompany me into their business with a copy of the judgement and then haul off their computers for collateral until they pay. Is he for real?

Yes, you can take a law enforcement officer (usually a sheriff or marshal), along with your judgment into their business and cause certain of their assets to be seized until the debt is satisfied.

But, computers, desks, chairs, or pigs can't buy you love.
They are not cash.
But, they can be held until the cash is paid.
Or, until you sell the assets.
A better strategy is seize or levy against their bank account.
This is similar to seizing an individual's bank accounts by a creditor.
You can garnish their cash flow (receivables).


Or, you can hire an attorney (or private investigator) to do this for you.
I do this.
Someone does it in your area.
Ask your attorney friend.
The person you engage to collect your judgment does it for a percentage of what they collect.

Some people might do it for a flat fee.
Ask around, it is a lot easier.
