I purchased a product over the internet from a company in Texas, The product is not what I wanted and they refuse to give me a refund.

What I need to know is, if I want to sue them in small claims court would I have to goto Texas to file suit or could I do it in my home state?

If I can file here does that mean they would have to come to my home state for court, etc. ?

I dont know how this process works, Any advice from a lawyer would be great.

Please help,

A: The best thing to do is sue them in Texas. If you don't want to do that, then you would sue them in your state and get a judgment. Then you go to Texas and try to register that judgment as a foreign judgment and execute on it in Texas. I am not a Texas lawyer, but from what I have heard, that is extremely hard to do.

This is not legal Advice!

Your quote "I purchased a product over the internet from a company in Texas, The product is not what I wanted and they refuse to give me a refund." and now you want to sue..... Before you start to jog off down this track, make sure you have read there terms and conditions carfully!!!

Good Luck.
