how far can a spouse get involved if not married?

I am a single mother of 2 boys 10yr and 4yr old. I just had a case and have joint/legal custody of my boys. I am to pay child support since their father is currently under unemployment. I currently have my children under my employee insurance but its too expensive I did ask the court if he can try to provide a cheaper insurance and I could just pay him instead of paying $500 a month. I was willing to pay a cheaper premium then what i pay now. What he did is added my children under his girlfriend insurance they are not married and have been together 3yrs and been living with her 1 year. Is it legal for them to do that? He hasnt provided me with their insurance cards like he was supposed to. Now wouldnt that be consider double income on his end were it can help me not pay him child support since she wants to involve herself in something that has nothing to do with her. Isnt it by law you are to be married to him before you can add my children as her dependents? Can anybody assist me with advice I dont know what to do.
 
His girlfriend's income can't be used to increase his earnings. Those aren't her children. As I said before, haul his deadbeat carcass before the judge and litigate it, again. No one on this forum has any authority to make either one of you do anything.

It can be. It depends on the definition of "eligible dependent" on the policy in question. The policies provided by my employer would permit this as long as he and his girlfriend registered as domestic partners with an applicable municipality, completed the employer-provided statement of domestic partnership, and provided birth certificates for the children.
