Drug Crimes, Substance Abuse How long can the police hold my son in jail without reading him his maranda rights?

My son was picked up from my house , 4 days ago. The police said they were going to talk to him about something that happend 8 months ago. They took him in there car no handcuffs and said they would probably be right back...Now he is in Jail. 1 count of possession less then 20grams (misd) and 1 felony sale and delivery.(5grams opf marjuana) They told him that they have him on tape saleing to an undercover..they also wanted him to give up some names and he would not..so they locked him up. ( Why would they need him to give up names if they have video tape?? Of course he couldnt give the names that they wanted so they took him to jail and set a bond at $12,550..I saw him this morning and he said he has still not been read his rights or cuffed..I do not have the $ to bail him out. They said he will have a court date on the 26 of Jan. Can they really hold him?

He has been arrested. So, yes, they can hold him until arraignment.

Most cases never require Miranda rights to be read, but if he was in custody and interrogated without the benefit of Miranda, then any statements made and the evidence that resulted can be suppressed.

He needs legal counsel ASAP. if he cannot afford an attorney, one should be appointed for him by the court.

Now, he could blab (snitch) on others in his gang, and the persecutor might go easy on him.

He needs to get it in writing.

He should shut up, even to you, until he meets with his lawyer.

By the way, he sucks at drug dealing, if he can't make a lousy $1,200 bond.

He needs to come up with 10% of his bail amount, not all $12,000.

Anyway, tell him to keep his mouth closed, plead not guilty, ask for a free, taxpayer paid lawyer!!

Just so you KNOW, mom; everything you say during a jail visit is recorded.

They also record every telephone call.

Hey, about that "Miranda" warning, they use EVERYTHING you say and do against you.

I sure HOPE Junior hasn't been BLABBING about what he's been doing!!!!

If he has, STOP.

Just talk about how he feels, is he eating enough, wish him well, tell him the cat misses him, get it? Great!!!!!
