I would like to initiate a small claims lawsuit for deceptive trade practice in Texas. The company is an international airline that operates (i.e. at airports) in the state. I have contacted the Secretary of State's office, and there is no registered agent. I was able to find a registered agent in California, but not in Texas.

I do have an identified employee with the company in the state with a physical address. Can I use this information to serve the company using this employee as a proxy agent for the company? What alternatives do I have?

I have already attempted to resolve the issue with "customer service" but received a complete run around.

Work with your Secretary of State and Attorney General's office and you should get the info you need. You might also find the info you need at an airport where the airline operates.

... and no... don't serve the employee. That will do you no good.

Secretary of state has confirmed that no registration exists. It is possible that the airline is "transacting business in interstate commerce" they may not be deemed to be "transacting business" in the state of Texas according to the Texas Business Organization Code.

I do not believe I can have a small claims complaint served to a non-registered entity (although I can verify registration in other states).
