Eight years ago I was arrested for fooling around in a club. I spent a day in jail and was let out on bail. When I was released, I was instructed that I would recieve information about my court appearence date in a week and if I did not, I was supposed to call a number.
After a week, I had not heard anything so I called the number. I was instructed to wait for an arraignement date, and there would be no need to to call back. I never got anything. I checked several times on the Clerk of Courts website over the next couple of weeks, and nothing. When I called again, I was told that the prosecuter had probabaly decided not to prosecute. For years, occasionally, I have checked my case on the website and the arrest is there, but nothing else.
I am looking for a new job an was concerned what would come up on a criminal check. When I looked up my case, I saw that the infomation was still the same - Open and with no future actions. Wondering what my prospective employer might see, I paid a fee to see the details.
To my horror I see that there was an arraignment - two months after my arrest. It says I was a no show and there is a capias. I am thinking this means they have orders to arrest me. But when I looked under the warrents area, it says NONE.
This was over six years ago. Since then, I have not heard anything about this. No one has ever contacted me or notified me that I was in any kind of violation. I have even done jury duty.
I am not sure how to handle this. I want to clear is up, just so it is over. However I certainly don't want to go to have this cleared up and they throw me in jail. Is there a way I can deal with this without that possibility? Can I just alert them to the error and just have a court date scheduled?
