I need some advice on wage garnishment.. I had a judgment put against me by a debt collector in the beginning of December for 4500.00 I just pled that the debt was mine due to the fact that I was going to file bankruptcy when my taxes came in.. Now I have a little delay before I can pay for the bankruptcy in full.. I tried to just make a payment plan with these people in January so I could by some time. Due to lack of hours and a ton of bills I couldn't come up with the 400 down that they wanted by the end of January.. Now they are threading to garnish my paycheck. I do not have no money in the bank since god knows when but how long would it take for them to take money out of my check? Would there be another court appearance before they can start garnishing my paycheck? I hear I can file for wage exemption so that cant go into my check do to the fact that I am head of household and have a small child. How do I go about getting that done? Do I have to pay the clerk of the courts to file that? Please help me by time til I can get my bankruptcy done..
 
File for bankruptcy immediately. You can file an emergency petition and this will put a stop to ALL collection efforts including garnishments; you WILL have to pay the full filing fees before it will be discharged though but you can ask the bankruptcy court to pay the fees in installments.

Call the bankruptcy court in your area (or go to their website) and get the forms you need (it's usually about 1/3 of the entire package of forms), fill them out and send them in immediately.

(This assumes you aren't using an attorney)
 
In what state do you reside?
Do you earn your wages in the same state?
Some states do not permit wage garnishments.
