HSN/QVC collections

Here's the scenario I would really like some advice on…preferably someone who works at one of these places or is very familiar with debt and collections.

My roommate is a habitual cheapskate. Always returning items for price adjustments, etc. Recently I have noticed packages from QVC and HSN coming to our residence with a different name and she says they are hers. I also noticed the other day she bought quite a few prepaid visa cards. After visiting the sites I figured it out and here's what happens...

Creates a fake email, fake name, gets a prepaid visa. Buys items on QVC/HSN under flexpay with the fake name and pays the first installment with the prepaid card. The items are shipped to the house. then when they try to charge the other installments, declined.

What happens with this? Can they track her down off a fake email, fake name, and prepaid card? I dont think these places collect SSN so how can they collect?the fact more people dont do this speaks to me saying "they must have a way to prevent this"..ie, legal action. and surely she can't be the first person to think this scheme up.....right? obviously the order is linked to our real address...but what are the legal repercussions of this as far as collections, fraud, police? Is she really smart in finding a loophole or really dumb for this? (rhetorical)

I want to be prepared with proving I'm not involved since this is my legal address as well. How far do these companies go for less than $500? tracking IP addresses on laptop? will the police show up on my door one day asking questions? Someone please help give me some clear answers, I do not want to keep being up at night scared of getting a knock on the door or scared of getting served lawsuit or collection papers one day. please help.

You have done nothing illegal, yet.

You have the right to remain silent.

If the police arrive and wish to question you, you can decline to speak with them, or say, "I don't know anything about this."

However, you appear to be living with a thief.

This is another reason to not become involved in roommate situations.

You didn't buy prepaid cards.

You didn't create phony email accounts.

You didn't call HSN or QVC.

You didn't buy a piece of junk, pay $19.99 and agree to pay two more $19.99 payments.

I suggest you advise your roomie that when the "feces hits the fan", you're going to protect yourself.

However, that might cause her to blame you.

Again, you won't be on the security tapes at Walmart, Walgreens, CVS, or someplace else purchasing prepaid Visa cards.

If things are as you claim, your feathers might get ruffled, but you won't get plucked.

Its time to get as far away, as fast as you can from that thief.

HSN & QVC only accept MAJOR CREDIT cards for these short term payment options, as in you pay $20.00 for three months to get the junk today.

I suggest you DON'T attempt what you think is clever!!!!

It won't work, if QVC & HSN do as their websites say.

The company CAN do many things. It MIGHT do some things. It MIGHT do nothing. Your question, in the abstract, is impossible to answer, even by somebody

who works at one of these places or is very familiar with debt and collections.

Worst case scenario she goes to jail for fraud. Best case - nothing happens.

But if the police come to your door either invoke your right to an attorney and keep your mouth shut or ask for immunity in exchange for throwing the little thief under the bus.

You've watched Professor Duane's video. He makes it pretty clear in the video that saying something like "I don't know anything about this" is absolutely the wrong thing to say.

Best to just invoke the right to an attorney and the right to remain silent.

True, but if the OP is innocent as she declares, she need fear nothing.
 
Thank you so much for this. It is correct that no matter what extent it goes to, it won't be my card purchasing visas, wont be my IP, etc.
I also have an account at HSN, in good standing, and have never had an issue with HSN or QVC. let's hope she doesn't get our address "blocked" or something!

I guess my biggest concern is the shared address and we are females living in the same residence...we share pretty much everything.
if it goes to that extent -I fear it is much easier to connect me as a co-conspirator than to prove no involvement

I would think just submit it to collections? and then i may just get annoying letters to the residence.
But then again...this is technically theft, correct?

Paypal forces you to link a bank account i believe so she wouldn't be able to have a fake Paypal with fake visas.

QVC and HSN don't take prepaid cards, mate.
 
As I stated, this is me watching and making assumptions. I didn't exactly ask her what her process was, or even if the two were related. since it happened all in the same week, I just thought that's what was happening!

Again, I always pay with my credit card so, I have never looked at the terms to know what they accept or how it works..i know my Visa is accepted and that's all I care about regarding payments.

If you refer to my original post, I'm not interested in their payments but i am interested in the legal ramifications of me sharing the address used for fraudulent activity.

But THANK you again, for your gratuitous accusations.
 
No one's going to mobilize the FBI over $500. Mind your own business and don't worry about your roommate (and then, when your lease is up, move in with someone whom you don't suspect of being a criminal).
