My husband and I went through tough times and ended up with lots of bills that went to two collection agencies. We verbally agreed that I would pay the one that was sueing us, with my student loan money, and he would start paying the other. I have proof of paying that judgement. Then three months later he admitted to sexually abusing my daughter, and my world came crashing down. I was hysterical, homeless, and distraught, while going through the divorce. He had been found guilty and sentenced, while I started the divorce process. My divorce lawyer said to drop the other collection debt to just my daughters medical bills, and make him pay that. He did not pay anything until I told the collection company to go after him, and now I am being sued for all the bills he originally said he would pay. Can I go back to that original agreement that we as husband and wife made, to take him to small claims court?
 
I have no idea as to the answer. Everything is in your divorce agreement. If you made a subsequent agreement it's hard to say although his breach of agreement might enable you change your position. I just don't have all the papers to tell you but you can always try. Good luck and very sorry to hear about your problem.
