husband excluded from policy

my husband was excluded on my policy from my car. he was driving my car and involved in an accident. fault of the accident deemed inconclusive by the police report. because he was excluded from my policy it was deemed an uninsured accident- damages not paid husband lost drivers license.BUT my husband has his own separate insurance policy-shouldnt this be covered under his policy-allstate says no HELP
