Husband in prison wife up and took kids and left home

Need help husband is in prison and wife took kids and left their home they have together. Sense she left didnt she aband the home and that gives husband full rights. Also husband filing for divorce wife has new live in boyfriend they sold or junked all husbands belongings and fordged his name off 2 of the cars they owned together are they allowed to do that and also checks. Plz help need advice quick
 
No, this doesn't give the husband "full rights" to anything. She also hasn't legally abandoned anything.

Husband is in prison - what did he think his wife was going to do?

The incarcerated felon should know, his wife could use his felony conviction as a reason to obtain a divorce.

Although Indiana is a "no-fault" divorce state, the Petition for Dissolution of Marriage must state the reason for which the dissolution is being sought.

A valid reason or lawful grounds for divorce will be that which the parties agree upon and can substantiate, or that which the filing spouse desires to prove to the court.

The dissolution of marriage grounds are as follows:

Irretrievable breakdown of the marriage.

An at fault reason:

A felony conviction of either of the parties,
Impotence,
Incurable insanity for a period of at least two years.


Notice, adultery is not a lawful reason.
