Husband in Washington Wants divorce from unresponsive wife in Virginia

I was married while incarcerate in Haynesville Correctional Center in Virginia. My wife wanted an annulment about a year after we were married. When I was released 4 years later she did not provide a home for me as she previously agreed. We went our separate ways. I asked for a divorce and she has not responded. In my opinion she just wants the tax advantage of filing married head of the household. I left Virginia in 2008 and I only have the city of where my wife lives in Virginia. I also have her last know employment address.

I still want a divorce. Does anyone know if I can file from Washington state since I've lived here 4 years now? Also is there any way I can file by deposition in Virginia and file for divorce in Virgina without setting foot in that state?
 
You need advice that is very specific to your situation.

I suggest you discuss this with an attorney in WA.

You can't get a divorce simply by filing a deposition.

Seek the counsel of an attorney in your county.

You face many legal pediments and obstacles.

You could search VA divorce records for her last known (and nearby) county. You might already be a free man.

You should be able to file in WA and you should be able to use substitute service to serve her. However there are guidelines you "must" follow to do this and you "might" have to file in other state. Since many Attorneys offer free consultations it would be wise to get a few and know what you need to do before you start
