Husband is threatening to evict me in CA.

I live in Oakland with my husband. We have been married for 2 years and have had trouble getting along the whole time we've been married. He keeps threatening to kick me out of the home we share. I am an unemployed full time student right now and cannot afford my own apartment at the moment. The idea of divorce is already an improvement from my current situation, so I am not looking for relationship advice. I need about 6 months to get a job and gather money to re-home myself and the dog we acquired during our marriage. Can we file the summary dissolution form if I am requesting this or do I need to a lawyer to help me file the regular divorce?
 
You are a married couple living in the residence together, happily or not. You are not a tenant. He can not have you evicted and you are under no obligation to leave against your will. If he locks you out you can force entry without consequence, and you can let him pay gor the damage for being so dumb.

If he is so unhappy he can leave. You are married- what is his is yourse, and yours is his. It does not matter who's name is on paperwork or who pays the bills.

He does not have the ability to force you out.
