Husband and I have been having problems..he has cheated and then has tried to do it again. We got into a big fight and I left to diffuse the situation. I spoke with him yesterday and was planning on returning but I didn't like the attitude he had. He basically said that if I wanted to come back and help with his daughter and pay bills then fine. I felt that if I went back then it would just be yet another argument. So I didn't. He called me last night and accused me of screwing around with a friend of his and told me that I wasn't allowed anywhere near the house.
I spoke with him today and he said I could come get my things but that he didn't know what I thought I was geting. Everything was his. He also told me that in no way shape or form was I coming back to stay there. He was tired of my lazy fat ass laying around and mooching off of him. I am unemployed at this time but I am receiving unemployment. The reason for the unemployment is that we had just moved to Pueblo at the end of Nov.
When I left I took very few articles of clothing and I had my friends pick me up from Denver a 100 miles away. I have very little money left, no vehicle, and really no place to go. Is he allowed to do this?

No, that's the marital home, so you have every right to stay there until one of you files for divorce and the judge tells you otherwise.

I want to Thank you for responding so quickly. I do have a few more inquiries, if I may.
My husband is OTR Truckdriver and is gone quite alot. I know that he has contacted the landlord (a friend of his Dads) and that the landlord is keeping an eye on the place. I would contact the Sherriffs Dept. to let them know of my plans...to go through boxes and collect my things. It would be at the very least a 2 day project. Most of our things were still packed as we just moved in Nov. This would be option #1.
Option #2 would be to go down there and just grab all of the boxes and go through them at my friends house. Which, of course. would take only a few hours. After going through the boxes they would be available for him to pick up.
Option #2 would be the quickest but I am not sure of the ramifications of taking things that are not mine.
Then the final question is, what if I go all of the way down there and he has changed the locks since I left? Do I have the right to contact the landlord and request entry?
If at all possible I would appreciate you answering these questions as I have been getting the run around with the lawyers I have contacted. They merely answering the question short and sweet and do not elaborate. Thank you for helping me.
