husband's former employer owes him 50K in commissions

My jurisdiction is: Colorado

My husband's former employers refuse to pay him commissions on his sales for a period of between 2-5 years. He has not been with that company for 18 months or so. Original correspondence indicated they knew they owed him and wanted him to tell them which "jobs" he was owed for. One of his co-workers told him the bosses wanted to "keep him out of the loop". In one correspondence they claimed that my husband hadn't been paid because somehow his name had been left off the paperwork. They now claim they don't have to pay him because of a statute of limitations. Could we sue them (My husband figures the minimum they owe is 50K) and if we did what are our chances? By the way we are in CO, but the company is in MT.
 
There is no, we, here. You have no standing in your husband's employment relationship.

Anyone who has a filing fee can sue for anything, so sure your husband can sue them. But on the basis of a single paragraph of information from someone who is not exactly unbiased, and without seeing any of the paperwork on either side of the issue, it's hard to say what his chances would be.
 
The jurisdiction depends on the facts of the case. With this much at stake he needs to be talking to an attorney. There is nothing that anyone on a free forum can do to help except to tell you that he needs to act quickly since the SOL may have already run.
