I am married and going threw a divorce with one man and pregnant by another. What are the biological fathers rights and what are my husbands rights to my baby?

Since the baby was conceived during the marriage, your husband is the legal father. He will have the same rights as any other father. However, both men will be able to challenge paternity if they wish.

Is your husband going to challenge paternity? If he doesn;'t then he is the legal father and will pay support. I cannot imagine he will want to support a baby that is not his if you 2 are getting a divorce. The bio father has the right to ask for a paternity test and to be recognized as the legal father.
