I am being compelled to share IP logs...

I own and operate a small community/political website.

A user under a pseudonym posted nasty things about individuals and their political party, which the complaintans say is libel/slander. I'd agree that some nasty things were said, some of which may be untrue. I pulled the post when they complained (as I feel I should have) so as to not be a part of the problem.

Their lawyer sent me a letter compelling me to turn over the IP logs. I asked a lawyer buddy and he said to turn them over unless I have a reason to harm the "victims" or if I have a good reason (and money) to try to protect the author.

I'm ready to share the IPs, but wanted a second opinion. I use my real name on my forums (as do others) so as to be on our best behavior.

What do you think?

Tell them to get a court order. If you do this no one on site will trust you or site again. Freedom of speech will disappear on your site for fear you will turn this over to those they have a dispute with

The letter threatens that I will be considered part of the problem if I don't reply in kind. Are libelous things said part of free speech?

I solicit anybody else's feedback as well.

I agree

Also add a line of text to your FAQs page stating you will comply with all law enforcement agencies/court orders compelling release of information/material submitted by site users.

Jacksgal is correct - exactly what were you sent? Did the lawyer just tell you that he is compelling you to send over the logs? Was a case even filed? You have no idea if someone is hoping to use you to go on a fishing expedition. Ask them to send you a document that compels you to turn them over such as a court order or subpoena.

Your lawyer friend was probably referring to issues concerning imminent danger to another person. If there was a threat to kill someone by 7pm the next evening, it's a completely different matter with regard to your members' safety than it is when the matter is about joe123 calling jane234 a senseless fool who embezzled money from the Acme Corporation and is a convicted felon who lives on Mulberry Street.

Good luck to you...
