I have been living in my mothers condo in Az. for 10 yrs. She paid the monthly hoa dues. It is owned solely by mom & she has lived in Florida for 20 yrs, and she passed away April 2012. I have a copy of her will & she left the condo solely to me, this was her only real property. I paid the monthly hoa dues for 7 months then rec' d a letter from the mgmt.co. Jan.2013 stating that until I provided proof that I became the personal representative of my mom' s estate OR had proof ( deed) showing ownership in my name, they would not accept payment & I would not have ownership rights, etc.. They had a copy of mom' s will & death cert., which had the personal reps name & address, it also had the name of mom' s atty in Florida who drew up the will, etc. July of 2013 I was handed a lawsuit... I was being sued by the Assoc. for unpaid hoa fees, oh, & they tacked on an additional $7500 bringing the total to just under $10K, ( didn't say what the addl was for). **My sis,the personal rep of the estate..... never probated the will, or had it recorded, nor filed the death cert. I'm guessing the Assoc. didn' t go after sis because technically there is no estate? Does that sound right? Property tax bills must get mailed to: estate of " mom" c/ o my sis( personal rep of mom' s estate). ** Who is responsible for the unpaid hoa dues & the lawsuit? My sis holds the title to the property & I assume it reads: ownership=mom' s estate or it' s still in mom' s name. ** Who is the responsible party while the "estate" is "in- limbo"?
