My jurisdiction is: New York, USA

Hello everyone! I got a question. I am looking to sue someone with a citizenship from Sweden but is currently living in Massachusetts, USA to attend school. I wired this person over $1200 between the span of a couple years and was told i would be payed back. I wired the money while this person was living in Sweden. Now lets say I could prove this person owes me the money, how the heck would i go about taking them to small claims court?

You just go to the court, have this person served and go to court-- However the most important part of a Small Claims action is the judgement-- if this person is not American they have no SS# so hitting their credit w/ a judgement will not be effective-- to be honest I am not even sure you taking them to court will be effective per they could (if thye wanted to) just up and go back home. But it is worth a shot -- after you get the judgement and you know where this person banks -- garnish the bank account on a day you know they just got paid.

There is very little more to tell. You take them to small claims by filing in Massachussets where they currently reside. You'll have a heck of a time collecting because there's no incentive to them to pay, but theresa gives some good ideas on what might be possible.
