I want to write out something saying if I was to pass away I would want my daughter to be watched over someone other than her father and to explain the truth about her father and how it would be safe if my daughter did not live with him. The courts don't do anything about it now but i would want them to if something was to happen to me. How would "I go about this?? thank you for any information.
 
If you have custody of your daughter, you can arrange for that custody to go to a specific person in case of your untimely demise. That, however, isn't as easy as it sounds, as regards divorced parties.

I suggest you discuss your concerns with an attorney. The initial conference is often free of costs.


But, I think you're worrying too much. You're not gonna die anytime soon. You'll be here to help your child become a responsible adult.

You can't "will" a child or use a will to legally designate custody.

You CAN suggest 'standby guardianship', but the court is not obliged to honor your wishes.

Unless the other parent is legally unfit, they will generally be first in line to take the child.
