I have not signed anything with new management company, am I under contract?

Hello,

We had a new company buy our building a couple of months ago. Since then our 1 year lease is up and we have been renting month to month. This new company never really introduced themselves and never had us sign ANYTHING. No new lease, no contract, nothing. Now just recently they implemented 24 hr security, and one of the security guards has been harrassing us and we want to move out asap!

When we told them about this they didnt even try to find out about what he was doing, just told me that we cant move out without a 30-day notice and if we leave any sooner we have to pay the full amount of rent for the month.

Is this true even though we have not once signed anything for this new company? We asked for a copy of our signed lease from the previous company and they gave that to us, but they printed their name on the top of it, passing it off as theirs.

Please help, we want to get out asap and are fine with paying the amount of rent we owe for the days of the month we have been here.

In the absence of a signed lease, a tenant is considered to be a tenant at will or, in your case (if you pay once a month), a month to month tenant.

As such, you do need to give at least a 30 day notice (and it is best if this is in writing) before you can vacate the premises.

Even if you give this notice and vacate earlier than the 30 days, you would still owe for the entire 30 day period.
