Okay so about two years ago the judge granted me soul custody of my son who is almost 3 now. The reason being that his father was charged with domestic abuse on me and my oldest son, he was ordered to pay $300.00 a month in child support and have no visitation until he completes drug and alcohol classes, rehab, anger managment and some others... Well he doesn't pay child support, he has given me about maybe 700.00 in the last two in a half years since the judge made the temp custody agreement before he granted me soul custody... He never calls to talk to him and when he does he doesn't call to talk to our son he calls to pester me... I honestly think that he wants nothing to do with his son but use him to try to control me... Well the years have passed and I am married and my husband who is rasing my son every day would like to adopt my son... I am not sure where the father is right now I do know that he is out on bond from jail right now for burglery along with several other drug charges... I know that my son doesn't really know his dad and if I am going to stop it I think it would be best to do it now rather than later and let him keep negativly effect my sons life... I am not sure what the laws are in louisiana or how to go about it... I would like some info if anyone has it... Thank you

You will need the services of an attorney to work this out. Your husband will not be able to adopt without jumping through many legal hoops.
It does not matter that he has not paid support, he is still the parent and has certain rights that even his absence doesn't eliminate.

You having sole custody did not likely remove his rights as a parent. He still has all his rights. You need to try to find him to see if he will release his rights to child in exchange you can tell him he will be free from futire child support
