I ran my credit report for the first time in a few years and found that I have a default judgement filed in December of 2004 that I was never served papers for. I had moved two weeks prior to the supposed summons service date. This was for medical bills from 2002 and one from 2004, totaling about $300. Plus they tacked on their attorney fee of $200, so the grand total of the default judgement is about $500.
So my big question is this: Since I just found out that there is a default judgement on my credit that I didn't know about, what are my options, nearly 4 1/2 years later?
1. Can I get the judgement set aside this far down the road since I did not know about it until now?
2. If I can get the judgement set aside, can the collections agency re-file it?
3. If they can re-file it, would the original collection amounts from 2002 fall under the six year statute of limitations? All of them except the one from 2004 have fallen off my collections record. It is $50.
4. What is the likelihood that a pay for delete will work on this?
I am in the position to finally buy a house, and I can't afford to have this stuff on my credit.
