My ex-husband and I have joint physical and legal custody. She is at my house Sunday through Wednesday and every other Saturday. She goes with her dad after school Wed. Thurs. Fri. and every other Saturday. The problem is that her dad is selling drugs and using drugs in his home and he allows others to do it as well. I have collected the proper documents need to file a motion to change parenting time, I just need to know what her rights are. Can I keep her away from there until the hearing?
 
Do you have real proof of her father's drug use and sales? You will need it. If you deny your ex's visitation, you may face a contempt charge.
 
if you think that is happening you need to call ur local police dept and start making reports and talk to someone there about your concern. how old is ur child? i know if the child is over 16 yrs old they dont have to go there.
 
That may not be true loving. If there is court ordered visitation not complying can place the custodial parent at risk for contempt. You are free to file a motion for supervised visits but that would be the most likely outcome.
