I sold my car to a private party on a weekend. We exchanged money, I released liability, I paid my car off at the credit union and the "Pink Slip" is being mailed to me, at which time I will mail it to the private party. Ten days later, I receive a visit by a private investigator to my place of employment. He hands me a demand letter asking me to return the money and they will return the car. Also, I got new tires on the vehicle before I sold it at the buyers request.
Now after taking it to a mechanic and finding problems, the buyer wants to return the car. I was given a "Demand Letter" asking for a refund of the money and the car will be given back to me. I live in CA, and believe that all Automobile Private Party sales are "as is". So i have anything legally to worry about?

As long as it had a current SMOG certificate and they received it, advise them to pound sand. The time for a mechanics inspection was before purchasing it. After that ignore them unless they file in court which they do not appear to have grounds to do as long as they are able to title their purchase normally.

When you transfer a vehicle title, it doesn't have to undergo a smog check as long as it's 4 years old or less. All you need to do is transfer to them a marketable (valid) title and your home free.
