Shoplifting, Larceny, Robbery, Theft I stoled merchandise from a department store

In Houston, Texas. It was $90.00 worth of clothes. I put it in my shopping bag. I got grabbed at the door. I got arrested, and went to the city jail. I got bailed later that night. I have a court date next week. I've been calling lawyers. I found one who told me that he was a former assistant DA for the court for Harris County court. He also said since it is my first offense, and I have no record. That I could possible get pretrial diversion and get no jail time. Or I could get probation with a fine. He told me 99.99% of people in my case don't get jail time. If I can't get pretrial diversion, would I be able to get this off my record if I hire a lawyer again?
