My son recently died on 20 Oct 2008, I was named Executor, Do I have to register his will with the county? His Daughter was named reciepent of all his worldly goods., however it is to be held by the Executor until she is 30 yrs old. and used for her health and welfare, and schooling, she is currently 23 yrs old. Will the Mobile home have to be registered in both names, and the land?? I am 70 yrs old and retired on a fixed income, so even tho I am trying to keep his home for his Dau, it is financially draining.

What's your jurisdiction?

As executor or trustee, you're entitled to be reimbursed by the estate for expenses you incur in administering it. I presume you don't want to burn it all up in legal fees, however, so the daughter actually has something to receive. But you should consult an estates lawyer to ensure you're doing everything properly.

The daughter might be interested in "collapsing the trust" - she might be able to call for her inheritance now, not wait 'til she's 30. Might save both of you some time and expense.

You have to file with the probate court. You can then petition the court to approve transferring the assets to her.
