I was fired in July for calling off because I had food poisoning. The store opened up at 4:30 AM and my shift started at 6 AM. They require a 2 hour notice but I could not give that. When I called off they said that was fine and I went back to the toilet. Then I returned to work on Tuesday where I was told that I could not work that day I needed to come back on Wed. to talk to the GM. He told me that I left the store down and I no longer had a job. But there are many people that just don't show up for work. Like they don't call off or anything and they still have a job there. Is this worth looking further into?

How long had you worked there at the time? How long have the other employees worked there?

Could be any of a couple of things, most of them legal.

Could be that after you left, they decided to lighten up - legal.

Could be that after you left, they implemented new rules - legal.

Could be that there are circumstances with the other employees that you do not know about - legal.

Could be that they have better overall records than you - legal.

For this to be illegal, you would need a valid and supportable reason to believe that you, and only you, were fired for this BECAUSE OF your race, religion, national origin, or other characteristic protected by law.

That person that no call no show did that while I was working there several times. But still continues to do it and is still employed. Also there was this time when money came up missing from the safe in the restaurant and they blamed me but couldn't prove it so they couldn't fire me. But then I called off. Would that be illegal?

I don't think you understand.

Nothing is going to retroactively make a previously legal termination illegal.

Unless you have a valid and supportable reason to believe that you, and only you, were termed for calling off BECAUSE OF your race, religion, national origin, gender, disabilty, pregnancy, age (over 40 only) or characteristic protected by state federal or local law, your termination was legal regardless of what happened with other employees.
