I went to the ER on 5/5/2014 for pain in my abdomen, when ER Doctor met me in triage and asked why I was there I told him it felt like I torn the inside of my stomach open. He lifted my shit poked my stomach, said I had an abdominal hernia. There is nothing he could do to see family doctor. Family doctor did same thing. Poked my stomach said yep it's a hernia. Sent me to surgeon, he sent me in for CT scan of abdomen. He say no hernia, I have a mass on right kidney, see a urologist. Seen Urologist last week Thursday. He wants me to see cancer specialist. My question is if the ER Doctor had ran proper imaging on me the 5th of May could I have gotten proper diagnosis sooner and not have had to go through the last couple months in less pain then I did? And do I have a case against them?

I hope you have a speedy recovery.
You might have the basis for a medical malpractice lawsuit, but if I were you, I'd focus on my recovery and improving my health.
If you think you can't wait, by all means speak to a few medical malpractice lawyers in yoru area.
They'll advise you accordingly and you can then decide what you want to do.
Again, good health and a speedy recovery.
They told me I'd be dead when I was diagnosed with cancer after being incorrectly diagnosed for two years.
Good thing for me that colon cancer isn't as aggressive as other forms of cancer.
Anyway, I made it (so far), and I bet you will, too!

Just a point:

A very dear friend of mine, and former poster on this board, died of advanced cancer a couple of years ago. She had a quick growing type and had probably not had it for as long as six months when she died.

The point being that it is by no means a given that the cancer, if it is a cancer, would have been visible in May. I am not saying don't investigate. I am saying, it's not as clear cut a point as one might think.

Your best bet if you want to pursue is to take your medical records to a medical malpractice attorney or two for review & discussion. We don't have enough information to know whether you have a case or not. I wish you well regarding you health problems.
