I was served a law suit, however plaintiff has put wrong name on it

In october (2014), I moved into new apartment. 2 of my neighbors (who are room mates together in their own apartment) each gave me $5000 Cash, to start a business venture.

The role they played was to simply give me money to support the business venture.

When asked if they wanted a return on their investment, they said yes, however

When asked how long before they would require a return, they agreed that there was no time limit. amd tovtskevas much time as i needed.

Less than 48 hours after cash was handed to me, they wanted a return.

No contracts or agreements were ever signed.

One of them threatened that his father was a judge in the state, and the other one posted pictures online of me saying that I was a Theif To all sorts of contacts.

Both of them assaulted and intimidated me several times on property.

I called police on them and they were instructed not to come to my door and they both agreed. I also agreed not to go to their door for any reason.

I was given an event# by the police and they told me if I am ever in another altercation that I could use that number as a reference.

They assaulted me again, 2 weeks ago, on property and security was there to witness. I did not call police and simply walked AWAY from their outbursts and accusations.

Under complete fear and duress, I texted them by phone as said I would try and return money by a certain date, just to get them to leave me alone.

They purposely used that text would make it seem as though it was our original agreement. And it was not.

They sued me for $10000, under grand larceny

I was served a summons by the security officer at the gate of entry to the apt, not physically at my door.

They have my FIRST name spelled wrong and completely wrong middle name. Last name correct. 10 days have already gone by since the summons.

What to do about this.

I wouldn't ignore the summons. Just having part of your name not correct generally will not let you off the hook.

Also, you really should report it to the police when you are assaulted.
 
I agree. A lawsuit or criminal charge won't go away because of a spelling error.

I'm afraid they may get that text admitted into evidence, and you made the mistake of not calling the police the second time. You should speak to an attorney.
