Alcohol & Drugs: MIP, MIC, Intoxication I Was The Designated Driver!!!!

okay so here it is another MIP you say?? I dont think so. I got an oppertunity to go to a free concert in SD California. Only thing was I had to be the DD...NO PROB! Everyone was 21 in my vehicle and all the alcohol was in the trunk closed, sealed containers. Im only 20 and had not had a drop to drink. I was drinking an energy drink. Anyways, as everyone is tailgaiting i gave my id and camera and various other things for my 21 yr old friend to hold in her purse. When i exchenged my items with her she gave me her beer to hold as she put my things away. (I now have the energydrink and beer in my hand) the next thing i hear " eveyone have i.d's?" (undercover cops). No problem i dont run dont flinch, i simply turn and answer them yes i have my id, and explain to them as i hand back the beer to my 21 year old empty handed friend that it wasnt mine and that she has my id. I DID NOT GO SO WELL... i got cited for an MIP 25662 (a) its marked as a misdamenor at the top but then an infraction. I was respectful and didnt argue the ticket.

Here is the kicker. Im an undercover decoy for alcohol and beverage control, and a rep for mothers against drunk driving. it didnt help. i was really just holding the beer. the officer who cited me actually worked for an agency i worked with a few months back and said because of my experience i should have known better. i basically got laughed at. Any advice? can i get this reduced somehow to an open container violation?

unfortunately you should have known that a minor holding alcohol is still in possession of alcohol even if you haven't consumed any of it. You should be able to speak with a judge but no one here can tell you what he or she may do.

Then you REALLY deserve no sympathy, whatsoever! If you went and ordered a drink with a fake ID at some restaurant, they give you one, and they end up with some huge fine, etc., then you consider that doing your job?

And I don't believe your story at all. Instead of putting the beer on their lap, or somewhere else, they give it to you? And a cop just so happens to be there for that fraction of time? Ha!
 
It does seem mighty coincidental that the officer just happens to catch you for the moment (a few seconds) you are holding the alcohol.

But, you can have your say in court as will the officer. Keep in mind that he was not likely alone, there was probably another officer who will corroborate what the citing officer saw.

Consider engaging local counsel if this is worth about $1,500 to you.
