Identity Theft within family?

My sister recently split from her live-in boyfriend, with whom she has a 2 year old child.

She subsequently discovered that this boyfriend/father had fraudulently obtained a credit card in HER name and racked up a large debt, which he is not able / willing to pay.

Is this considered identity theft, even though they are technically 'family'? (Although they are not married).

I'd love some advice as to what her options are at this point, thanks!

How did he get a credit card in her name?

I'm not intimate with the details, but I do know at one point he actually pretended to be a woman over the phone. Apparently it's not very difficult to trick a credit card company.

Post back when you know the whole story.

That is the whole story. He took out a credit card in her name and racked up a debt. I'm just wondering if there are any possible solutions to this BESIDES having him thrown in jail? Obviously sending the father of your child off to prison isn't the most favoured solution, if there may be another one.

Thanks...
