i am currenty married, i caught my spouse being unfaithful and have decided to cut ties. it will take awhile for me to file devorce and right now he will not leave my home (the house is in my name) now im sure that when he decides he wants to do something he knows he cant do here he will say he going to leave and move out and get his on place. and i know he thinks he has no responsibility so he will lost that place. so my question is,

(1) what happens AFTER he has decided he doesnt want to live here anymore, packs his bags, changes his address and live in his own place. can he 3-4 months down the line wake up in HIS HOUSE and say "hey i wanna go back to my wifes house"?

(2) if he does get a place by himself and moves and he can come back, is there any action i can take after he moves to keep him from returning prior to the divorce proceedings (ie: contracts, attorney supervised agreement, etc)?

i think him being here is going to cause a bad situation for me and i rather it not come to that or worse me having to leave my own home.

i kinda read up on this subject on the forums but didnt really find any info on a returning spouse.

thanks in advance for any help

I would be interested in what you find out. Wife moved out but she still has keys. It's my understanding that changing the locks would do no good - as long as we are still legally married she can break a window if she wants to get in. I am thinking a restraining order may be my only option - and possibly yours as well. Does anyone know how to file a restraining order without the expense of a lawyer?
