I was caught shoplifting at a store a year ago at San Joaquin County and i also live there. However, I was never convicted and the case was dismissed after I completed my plea of abeyance. I called the police records to see if there was still anything on my record and it still says that the incident occurred so i will be having my records expunged but that probably won't be processed by the time i go to court again. When i go to court for the misdemeanor in Solano County, will they know of my prior offense even though i was never convicted it or any crime? Can I expunge the previous offense so that they don't see it when i go to court?
 
Court will have access to any prior cases whether or not they were dismissed. So yes they will likely know. this will likely not go over well with Judge as you were given a chance once and now have comitted another crime. If you want to better your chances in court you might be proactive. read these two posts from another site and how this user benefitted from being proactive.
