Last week i went to a a street thats up a hill were you can see the whole city. i was the passenger while my girlfriend was the driver which she don't have a license and my brother and his girfriend in the back seat. once we parked i got some beer from the trunk and put the rest inside the car and my girlfriend goes and sits down in the front passenger side seat. I leave to walk round the street with a beer in my hand. Heading back to the car that belongs to my mom a cop going down the street pulls me by my moms car. The reason for such search was that the cops thought i was trying to break into my moms car. I told them the story and they were saying that i was getting arrested for an open container and driving without license. I told them that i wasn't the driver and my girlfriend admitted that she was the driver. There was no open beer cans inside the car just closed and no one was drinking but me. i didn't have the car keys and the car was parked. They eventially wanted me to sign to aticket that said i was the driver without license and had an open container. I refused to sign and they towed my car and took me to jail. I want to know what can i do to get my car released from the 30 day impound that the police place and what can i do to get my money back in what i spent to get the car out for illegal car seazure.

Okay, so the car STILL gets towed because she is also an unlicensed driver and you still get cited for possession of the alcohol ... the only thing you get out of the deal is that you do not get the driving while suspended ticket - she does.

That's what happens when you refuse to sign a ticket. Had you signed the ticket, you could have made your argument in court. The cite is not an admission of guilt, it is just a promise to appear. If you do NOT sign it, then you cannot be released on your own recognizance and have to go to jail.
