My dad was fired approxamately 4 years ago for "not being able to complete his charts on time". I could possibly type all day about how he increased the hospitals gross by over a million in just the two years he was there, how much the patients loved him, and when he was fired how 100's of patients protested outside the hospital for a day, but i will save us both some time.
My dad's contract said that the only way he could be fired is if he were to "commit a felony or lose his license". he never committed a felony and did not lose his license therefore, making the firing completely illegal.
My dad sued for the contract ammount: 1.2 million for the 2 years he remaining on it. Today was the case in a town 1 hour away from where he was fired (aka hicksville) and it was a jury trial. We just found out he lost the case because they said that he had lied on his resume, which he didn't at all because we have the application in our hands and it clearly says opposite of what they claimed. so that really makes no sense. EVEN if he did lie, that is not the reason they fired him, it was because of not completing his medical charts on time...NOT because he had supposedly lied on his application.
Also, the day before the trial, when they were picking the jury, the lawyers got to say a few opening lines to the judge. the hospital's lawyer had said that they were counter-suing for 900,000 because this was the cost to bring in a doctor during the remaining two years of my dad's contract. the judge dismissed this and said he must have been joking because they had just brought this up a day before and the judge said that they should have come up with that months ago so that my dad's lawyer could have done the research on it and add up all the receipts and paychecks and make sure they were legitimate. Also, the "CEO" who testified against my dad said that he still works for the hospital, which HE LIED! he was fired a year ago!
Also, the hospital has a 4 million dollar policy for lawsuits like this, so the hospital certainly has the money.
What do you make of this? We are certainly appealing and bringing it to the highest court in Harrisburg, but it is going to take another year or two to finally have the trial again. Our family certainly does not have the money to go for another two years for a case that we know we will win. They fired illegally which voids any other reason they have against him for this case.
My family is going through an emotional breakdown at the moment and could really use some advice. thanks.
