Illegal search and seizure

Per a reference I have, in Ca. sometimes as a condition of probation (you accept probation instead of jail/prison time), the probation agreement (you need to read it) will allow searches of you, your home & car at any time. If you believe you were victim to an unreasonable or illegal search, contact your PO or a lawyer.

We have a Ca. police officer who posts on this forum & I'm sure he can tell you more.
 
Can the police come up to you and search you without any reason even if you are on probation?


The fact that YOU are on probation or parole gives any law enforcement the officer the ability to search you, stop you, interrogate you, and even search your home.

They can do this at 3:00PM or 3:00AM.

If that happens, you're obligated to report ALL police contacts to your PO.

Yes. In CA the police do not even need articulable reasonable suspicion to search someone on probation. If I see a probationer walking on the street or driving past, I can detain them for a search with no specific reasoning.

They can search your residence, belongings, and vehicle without any reason, too.
