Bought a truck from a used car dealer / repair and inspection center. The truck is very loud. The day after purchase i took the truck to my mechanic/inspection center to find out how much it would cost to redo the exaust system. my mechanic looked under truck and came back out and asked where did i buy it from. I told him where and asked why... He replied back saying there is no cataletic converter on the truck, and it is illegal for me to drive it in my state. He then looked a the inspection sticker and said it was also illegal of the dealer to had passed the inspection, and sell it to me. The truck also has many other serious problems.
It was a 'AS is purchase" and this is the 2nd day Ive had it. Is this a Breech of contract at the fault of the dealer/inspector? I dont want the truck.

You've probably got a criminal violation against the dealership.

I'd contact this agency in your state that regulates automobile dealers, the DMV.

Before filing a complaint, I'd call them and explain your situation.
You have a great case, and I'm sure the sate will love to hear what this crook did.

You can call the MVDB Consumer Assistance Analysts at (804) 367-1100
You have some work to do, but this is a slam dunk.
So, be sure you eductae yoruself so you do it correctly.
Ask about this:
The Motor Vehicle Dealer Board (MVDB) is responsible for administering the Motor Vehicle Transaction Recovery Fund (MVTRF). The MVTRF reimburses individuals who have suffered loss or damage in connection with the purchase or lease of a motor vehicle due to illegal actions of licensed or registered motor vehicle dealers or salespersons.

Payments from the MVTRF may be made to retail customers and car dealers who obtain a court judgment and who incur loss as a result of:

Fraud practiced by a licensed motor vehicle dealer or salesperson in connection with the purchase or lease of a motor vehicle,
A violation of the motor vehicle dealer licensing laws in connection with the purchase of a motor vehicle on or after January 1, 1989, or the lease of a motor vehicle on or after October 1, 1998, or
A breach of an extended motor vehicle service contract entered into with a car dealer licensed in the business for three or fewer years beginning on or after April 8, 1994.

You can file a complaint online.

New motor vehicles generally qualify if they are less than four years old and have documented problems during the first 18 months after delivery to the first owner or lessee.
For used vehicles that are sold "as is" but without the mandatory Buyers Guide window sticker, buyers have the right to cancel the sale within 30 days.

You may also be stuck with the truck. Surely they will say the equipment was there when you drove it away. The time to inspect the vehicle is prior to purchase, not after.
Catalytic converters are not terribly expensive, especially if you were looking to put money into the exhaust anyway.

Thanks for all the input. He was gonna fix it all up... come to find out the head gasket is blown as well. Got money back and reported him to the State Police Inspection officer. He will be losing his Inspection license for 6 mos. and his dealers as well. I also think the local news got hold of the story as well...
