illegal (?) towing

I got towed over the weekend and am wondering if I have any recourse.

I was parked in my boyfriend's apartment complex parking lot, with a valid lot sticker displayed in my back window. The complex apparently has contracted a towing company to patrol their parking lots. His lease mentions all the things they can tow a car for - basically leaving the door wide open for them to tow any vehicle they want.

My car was towed for "expired" tags. I had the year sticker inside my car (for so long, in advance) and had forgotten to put it on the license plate. Had they ran my tags, they would have realized that my plates weren't expired. Aren't they supposed to call the police and do that, before they tow a car for such pathetic reasons?!?

As it was, I spent a frantic bit of time, convinced my car had been stolen. Only to find out, no, it had been towed (which, I must admit, was better than being stolen!) ... still, though, it doesn't seem that some joe blow towing company should be in the position of enforcing state licensing laws.

The apartment complex was in Fairfax County, VA and my car is registered in North Carolina. The month sticker was March, and I was towed on April 28th - not even an entire month "expired".

The guy at the towing place was a real jerk, too. Wouldn't let me near my car, to inspect it, to see if it had been damaged. Didn't ask for an id, despite the fact that my credit card was (purposefully) unsigned, etc, etc.

Is there anything I can do about my lost $100?

If your sticker was for 'March', then it expired at midnight on your birthday in march. By April 28th, it had already been expired for at LEAST a month. There is no grace period for registrations. The apartment complex does this to keep junk cars from cluttering up the place.

As for your CC, an unsigned card is an invalid card and may NOT be accepted by a merchant, period, "See ID" or not. Lots of places accept them, but they aren't suppose to, and could lose thier merchant account for doing so.

However, if you signed the receipt, you're going to be hard pressed to show you didn't authorize the charge.
