Illegal use of police dept computer systems.

back story- in July 2009 I was pulled over for a burned out tail light in Wisconsin. I was issued a warning and was sent on my way. I took care of the warning and never thought about it again. In Oct 2010 I moved to Alaska with my family(military move) and obtained an Alaskan license with no trouble. I moved back to Wisconsin(same town) in July of 2013.

Oct 1st 2013 at about 830am I have two police officers show up at my house stating that they had to take me because I had a warrant for nonpayment on a ticket. I was highly confused and they didn't have much to go on either. They stated they got a call stating where I lived, what I drove, my license plate, and a description of myself. I was even more confused at this point because only family and one friend had my address or further information about myself. I was a complete mess because I had never been in trouble before and I thought I was going to jail. I was taken down to the police station in my pj's in a police car to pay the bond on the ticket. On the way I asked many questions as to who or how someone may or may not have been able to get such information about me, since I was unaware of the warrant myself. The cop told me that I should look into it further since only employees of the police dept had access to such information without just cause. Still at this time I was unaware exactly what I had done wrong. After I was dropped off at home, I was instructed to go to the neighboring village to obtain hard copies of what the ticket was for. I did just that.

My ex husband's new girlfriend works as a 911 dispatcher for the town we live in. a week prior to the police coming to my door I had made the statement that we need to go back to court to sit down with a mediator to adjust our parenting plan to fit our current needs. That fell on deaf ears and so I stated that I would hire a lawyer to take care of the issue.

I filed a complaint with the joint services director at the police station, I had a meeting with the the director and the 3rd shift 911 dispatch manager. I had to file a police report of all the problems she had caused between my daughter's father and I, and why I believed she was behind this. I was told they would open an investigation and get back to me. I was later contacted and told that while she was put on admin leave, she resigned from her position due to this investigation.

I went to court and proved that I had taken care of the warning and the ticket was dropped.

THE QUESTION- Now that it has been proven that said girlfriend illegally looked me up and caused me 'trama', Can I take her to civil court and sue her? I want her to pay for her actions, and I further want a paper trail to follow her around, and have one for myself for when I do go to court for my daughter that I have that in hand against her father and his new girlfriend for when I do go to family court.

If she is a 911 dispatcher and she had knowledge that someone with an arrest warrant was coming to town and she passed that along, how is that a misuse of a law enforcement telecommunications system? Sounds like it was arguably used for a legitimate law enforcement function.

Having a warrant is supposed to be an inconvenience. Now you won't have to worry about it.

But, you are certainly free to pay an attorney and go after her if you want. If the agency and the county/state are not going to pursue her criminally, then it will be in your court - and it will be expensive.

It is not a crime for you to be inconvenienced by the truth You have no damages.

It is Illegal to use your position in the police dept for personal gain though. looking someone up without just cause, being pulled over etc. is not legal. it would be one thing if she used her position in the correct manner, but looking someone up while on the job and calling in at a later time to cover your butt is not okay. Inconvenienced by the truth isn't an accurate statement at all. The truth of the matter was, the situation was taken care of properly on my end back in 2009 and not properly on the police dept end back then. That was proven in court. For someone who has never even had a speeding ticket the whole ordeal was quite traumatic.
 
I still don't see anything worth pursuing here. However, you are free to talk to a lawyer as suggested.

I still fail to see how she did anything improper by looking up information on a person that she believed had a warrant. Yes, it would have been cleaner if she got someone else to look it up suggesting that she believed that Angie0504 had an arrest warrant, but it is hardly unlawful to use a police computer system to confirm the status if a warrant on a person!

There may be more to the matter such that it prompted the agency to begin some sort of action against the dispatcher, but she didn't have to ignore the fact that you (a wanted person) would be in the area simply because she was in a relationship with your ex.

Now, if there never WAS a warrant, and she lied about the existence of a warrant, that would be a different issue. So, at the time of the contact was there, or was there NOT, a warrant for your arrest?
