I'm a subcontractor, the contractor and home owner have a dispute, the home owner had the locks on the doors of the house changed. My tools are in the home and the homeowners lawyer refuses to return messages. The contractor says they are not responsible. I have already filed a lein on the property in which I received no payment from the contractor for work performed. Who is responsible for the return of my tools valued at over $1000. This has been going on for around six weeks and I have already replaced some of the items I need to make a living.

The homeowner is. This isn't governed by your contract; this is unlawful conversion of your personal property. I would write a letter to the homeowner advising them that they have no claim against you and no right to hold your tools, and if they are not returned forthwith, you will sue for their return and for the damages in lost wages that their loss has cost you.
 
Wouldn't he be able to contact the police in this case? I would think that since they are holding his items, that would constitute theft of the items.
