I'm getting sued when I already paid the insurance!

Two years ago I was involved in a car accident and I did not have car insurance. The other party nor I were hurt and the ambulance was not called also I was not issued a ticket. I got a letter from the other party's insurance collection agency about 4 months after the accident and they told me that I owed $1400. I did pay off the insurance company in January 2010. Recently however, I am getting bothered at work by the other party because it seems she is trying to serve me a summons notice to sue me. I do not understand why she is trying to sue me if I paid off what the insurance company said I owed them because of the accident. I was wondering, can she even do this since the accident was 2 years ago? I am a seriously broke college student who is a waitress and I cannot afford anyone trying to sue me and I'm confused on why she's doing such a thing. Pretty much I want to know how worried I should be about this pending lawsuit since the insurance claim is paid. Thank you for any assistance you can offer me.
 
There is one important point that you need to understand here. The other driver most likely filed a claim with her uninsured motorist coverage on her insurance. Her insurance then turned around and came after you. That was the bill that was sent, that you paid. Why she is suing you now is the big question. More than likely it's either something that her insurance wouldn't cover (although I'm not sure what).

Once you get the summons and you can read that court filing, that will answer most of your question that you need to answer, mainly what is she suing for? Once you have that, I would contact a lawyer who will do a free consultation in your area. The statute of limitations in Tenn. is one year from the date of the accident, so you should be able to have the case dismissed based on that. Besides, you were never ticketed and therefore not found at fault in the accident. The lawyer can let you know if there are any surprise packages in all of this that you need to know about.

Keep in mind that you can sue anyone for anything. Proving the case and winning it are another story.
